User Registration Agreement

Please read the following agreement carefully, accept the agreement to continue the registration.

Terms of Service of the agreement (hereinafter referred to as “Terms of Service”) are the rights and obligations concluded by the user (you) and the AMBRION SolarPlant Portal on the services provided by AMBRION SolarPlant Portal. Both you and the Portal shall be bound by the Terms of Service.

Services provided by eSAJ Home Portal are carried out strictly according to the relevant articles and regulations, terms of service and operational rules. User clicks “Agree” button through the registration process, which means that the user has reached an agreement with AMBRION SolarPlant Portal and accepts all the terms of service.

I. General rules

1.1. Ownership and operation rights of AMBRION SolarPlant are owned by SolarBOS Pty Ltd. (hereinafter referred to as “SolarBOS” ).

1.2. Before registering, users should read this agreement carefully and agree to abide by this agreement before becoming a registered user. Once the registration is finished, the user and the AMBRION SolarPlant form an agreement automatically and the user shall be bound by this agreement. Users should agree to accept relevant agreement before using special services or products.

1.3. AMBRION SolarPlant Portal reserves the right to modify the terms of the agreement without prior notice to you. You should check the agreement every time before using the service. Notice, announcements, statements or other similar content on this portal are parts of this agreement.

II. Service content

2.1. Specific services provided by AMBRION SolarPlant Portal are based on the actual situation.

2.2. The portal only provides related network services. Other equipment (such as personal computers, mobile phones, and other devices for connection to the Internet or mobile network) related to the relevant network services and the expenses (i.e.: telephone charges and Internet access fees paid for accessing the Internet, and mobile phone fees paid for using the mobile network) shall be borne by the users themselves.

III. User account

3.1. Users who complete the registration process and identity authentication through the registration system on the portal are official users, and will be entitled to all rights provided by the portal, while unlicensed ones will only enjoy some of the members’ rights of the portal. AMBRION SolarPlant has the right to change the design of the member’s authority.

3.2. Users can only use the real name and ID number for registration according to registration requirements. Users are obliged to ensure the security of the password and account. Users shall take full responsibility for any loss or damage caused by all activities carried out by using the password and the account. The portal shall not be responsible for any loss or damage. If users find that the account has been in unauthorized use or had any other security issues, you should immediately change the account password and keep it, if necessary, please inform the portal. For illegal use of the account due to hacking or users’ negligence custody, the portal will not undertake any responsibility.

IV. Rules of use

4.1. Comply with the relevant laws and regulations of Australia, including but not limited to the Regulations of Australia on Protecting Safety of Computer Information Systems, the Regulations for the Protection of Computer Software, the Supreme People’s Court’s Interpretation on Several Issues Concerning the Application of Law in the Trial of Cases Involving Copyright Disputes over Computer Networks (Law Interpretation [2004] No.1), Decision of the NPC Standing Committee on Maintaining Internet Security, Provisions on the Administration of Internet Electronic Notice Services, Provisions for the Administration of Internet News Information Services, Administrative Protection of Copyright on the Internet Procedures and Regulations on the Protection of the Right of Communication through Information Network as well as other laws, regulations and implementing measures on computer Internet regulations and intellectual property rights.

4.2. You acknowledge that before you start the registration process and use AMBRION SolarPlant Portal Service, you should possess the civil capacity that is appropriate to your behavior as prescribed by the laws of Australia. If you do not have the aforementioned civil capacity that suits your behavior, you and your guardian should be responsible for all the consequences caused hereby according to laws and regulations.

4.3. Users must provide accurate company information and personal information when registering at AMBRION SolarPlant Portal. If there is any change, please update it in time.

4.4. After the user registration is successful, AMBRION SolarPlant Portal will give each user a user account and the corresponding password, the user account and password shall be kept by the user; the user should be liable for all activities and events carried out on the user account.

4.5. Users registered at AMBRION SolarPlant Portal must follow the principles below:

a) To comply with the relevant Australian laws and regulations;

b) Not to use AMBRION SolarPlant Portal for any unlawful purpose;

c) To comply with all network protocols, rules and procedures related to network services;

d) Not to use AMBRION SolarPlant Portal for any activities that may cause adverse impact on the normal operation of the Internet;

e) Not to use AMBRION SolarPlant Portal to transmit any harassing, libelous, abusive, intimidating, vulgar and obscene or any other illegitimate information materials;

f) Not to use AMBRION SolarPlant Portal for any behavior that is adverse to the AMBRION SolarPlant Portal;

g) If any unauthorised use of user accounts or account security breach occurs, notification shall be immediately given to AMBRION SolarPlant Portal.

4.6. Users are solely responsible for the content they publish, upload or transmit. All users are not allowed to post, reprint or send the following information on any page of the portal. Otherwise the portal has the right to handle it without informing the user.

a) Violation of the fundamental principles established by the Constitution;

b) Endangering national security, disclosure state secrets, subverting state power and undermining state unification;

c) Damaging national honor and interests;

d) Instigating ethnic hatred, ethnic discrimination and undermining national unity;

e) Undermining the country’s religious policy and promoting cults and feudal superstitions;

f) Spreading rumors, disrupting social order and undermining social stability;

g) Disseminating obscenity, pornography, gambling, violence, terror or abetting crimes;

h) Insulting or slandering others and infringing upon the legitimate rights and interests of others;

i) Incitement of illegal assembly, association, procession, demonstration, mob gathering to disrupt public order;

j) Activities on behalf of illegal civil organisations;

k)Other content prohibited by laws and administrative regulations.

4.7. Users promise that all information posted on or uploaded to the portal by them (i.e.: works stipulated in the Copyright Law of tAustralia, including but not limited to texts, pictures, music, movies, performances and sound recordings, computer programs, etc.) possess full intellectual property rights, or have obtained the legal authorisation from the relevant obligee; If the portal is claimed by a third party in violation of the article by the user, the user shall compensate for all costs of the portal (including but not limited to a variety of compensation fees, legal representative fees and other reasonable expenses for the purpose);

4.8. When a third party considers that the information published or uploaded on the portal infringes upon its rights and sends a notice of rights to the portal pursuant to the Regulations on the Protection of the Right of Communication through Information Network or the relevant laws and regulations, users agree that the portal may, at its sole discretion, decide to remove the allegedly infringing information. The portal will not automatically recover the deleted information unless users submit the written evidence to exclude the possibility of infringement;

4.9. If users violate any of the above rules when using the network service, the portal has the right to require users to correct, or directly take all necessary measures (including but not limited to deleting the content posted by the user and suspending or terminating the user’s right to use the network service) to reduce the impact of users’ improper behaviors.

V. Privacy protection

5.1. AMBRION SolarPlant Portal attaches great importance to protecting the privacy and personal information of users, and hopes to establish a harmonious mutual trust relationship with users.

When you use the software and services provided by AMBRION SolarPlant Portal, we may collect and use some of your relevant information. Hereby, we will explain how we collect, use and store the relevant information as we provide services and how we provide you with the control and protection to the safety of such information and privacy based on the Privacy Policy. The Privacy Policy is closely related to the AMBRION SolarPlant Portal services that you are using and please read it carefully. By using or continuing to use our software or services, you agree that we could collect, use and store your information in accordance with the Privacy Policy.

5.2. Information we may collect

When you use the software and services provided by AMBRION SolarPlant Portal, we collect some used information and send it to our server. The information received by our servers can be divided into three categories, i) the identity of users and the communication information, ii) information about how users use the AMBRION SolarPlant products, and iii) summary statistics of the data owned by the users. We collect information to provide better service to all users, including both inferred and basic information (e.g. the language you use, we can optimise the service based on the language you are using and push notifications with your preferred language, etc.), also including more complicated information (e.g. to determine your business scope according to device positioning, judge which carrier/user you operate with frequently based on the work order you create/receive, which brand of your equipment and what kind of problems your equipment often fail, etc. We could provide you more accurately with relevant advice or analysis of your cause of the malfunction, and provide relevant advice and other services according to the above information.). We have two ways to collect information:

(A) The information you provide to us

When you sign up for an account to enjoy our services, we may ask for personal information such as your name, nickname, e-mail, and sometimes your ID card information and other personal information to provide you with a full service or technical support.

Information you have shared with others through our services, and other information that is actively stored through our services, such as information that is stored and shared through a collection function at AMBRION SolarPlant, the content stored through the cloud storage service.

(B) Information we obtained in the process of your use of the service

We will collect information about the services you use and how they are used, such as when you watched the video, when you visited a site that uses our promotional services, or when we reviewed and interacted with our promotions. The following is about what information eSAJ Home Portal products may get.

1) Log information, refers to the technical information collected automatically by the system when you use our service, including:

Hardware configuration and software version, such as configuration information provided by your mobile device, web browser or other programs used to access our services, your IP address and mobile device’s version and device identification number (IMEI); AMBRION SolarPlant Portal software and other software information, for example, the version of AMBRION SolarPlant software, the frequency of using AMBRION SolarPlant list, the main purpose of using AMBRION SolarPlant, information about your use of other APP softwares, such as the use time, the use frequency;

Information on the function of the AMBRION SolarPlant Portal software, for example, whether there is a breakdown in the process of using the list of eSAJ Home and other software failures, whether the phone is connected to the computer successfully and other issues, and product improvements;

The statistics of use of each function: AMBRION SolarPlant Portal has provided many kinds of functions in the software. We use these data to judge your preference for each function of AMBRION SolarPlant Portal, evaluate whether our products are matched with your using habit and make corresponding improvement.

The overall statistic information in the phone. For example: how many contacts you have in your address book? How many of them have been added to your favorites? How many applications you installed and how you use these applications? How much music, pictures and video is stored in your phone. We only summarise the information and use these data to improve the design of the product. For example, after understanding the fact that the average number of music users owns is not large, we are going to greatly simplify the redesign of the music management feature.

Data synchronization, sharing and storage. Some services provided by AMBRION SolarPlant Portal allow you to synchronize, share and store the data, and we will collect and store the data you choose to upload, download or implement.

Information you search or browse while using our services, such as the keywords you use for web searches, the URLs of pages visited, and other information and content details that you browse or request while using our services;

2) Location information, refers to the information we collect about your location when you turn on mobile device targeting and use our location-based related services, or we collect information about your station/inverter location when you use our monitoring platform, including:

i. Your geographic location information collected by GPS or Wi-Fi when you use our services with a mobile device with locating function;

ii. The geographic location information of your inverter or power station that we collect via GPS or Wi-Fi when you use the products supplied by AMBRION SolarPlant Portal;

iii. Real-time information from you or other users, or from your station/inverter, that contains the geographic location where you or your inverter or power station resides, for example, your area information contained in your account information, you or others upload shared information that shows you your current or former location, such as geo-tagging information contained in photos that you or others share;

iv. You can stop our collection of geo-location information for your mobile device at any time by turning off location targeting.

3) Power generation information. When you use our portal to monitor the power station, we collect information about your power station, such as power generation, revenue and other information.

4) In addition, there are some points to keep in mind when you use certain functions:

The application upgrade function sends a list of apps you’ve installed on your phone to our server so we can tell you which apps are available for upgrade. Cleaning function of your mobile phone will optimize internal storage of the phone according to the current application usage condition of the user’s phone, to help maintain clean state of the users’ phone.

If system collapse happens unfortunately in using AMBRION SolarPlant, the collapse report sent may also contain small amount of relevant data information you’re operating and this is required for our diagnosis.

If you open the website through AMBRION SolarPlant Portal, the web page can get the standard log information, including IP address, cookies and so on. This is the same as you use a normal browser.

If you choose ‘remember me’ on AMBRION SolarPlant Portal, your data will be saved in a copy on the computer you’re currently using. This is why we just recommend to use this function on your own computer. You can delete the saved data in the settings.

5.3. How we use your personal information

AMBRION SolarPlant will just strictly follow this privacy policy and the upgraded content to use your personal information. Your personal information will be used for purpose confirmed and agreed by you, and for any other usage we will get your agreement in advance.

The personal information we collect will be used for confirming function and safety of our products and service, verifying your identity, preventing and tracking cheating and other improper usage condition.

The personal information we collected will be used for our product and service development. Even in general condition, we just use comprehensive information and statistical information for this purpose.

The personal information we collected will be used for communication with you. E.g. notice will be given to you immediately when an AMBRION SolarPlant product or service is released.

The personal information we collect will be used for personalized design of products and providing more suitable service for you. For example, in our service, content and promotion especially designed for you will automatically be recommended and exhibited.

If you participate in lucky draw, competition or similar promotion activities, the personal information we provides for you will be used for management of this activity.

Under the premise of not disclosing the privacy of individual users, the portal has the right to analyze the entire user database and user database for commercial use.

5.4. Use of non-personal information

For the information we collect and can’t be directly connect with any special personnel, such as usage preference, hardware configuration, location information and software operation information, etc., it can help us better understand user’s behavior and improve our products, service, promotion and advertising.

For other information you share through AMBRION SolarPlant service, for example, the application information you collect and share will be shared with the third party for use as per demand of concrete products.

5.5. Information we may share

The portal is not open to the outside or will not provide third parties a single user’s registration information, and users’ non-public content stored in the portal in the use of network services of, except the following cases:

i. Obtained express authorisation from user in advance;

ii. Required by relevant laws and regulations;

iii. Required by relevant government authorities;

iv. To safeguard the interests of the general public.

Out of providing AMBRION SolarPlant service or carrying out the obligations and rights in our User Register Protocol or this Privacy policy, we may carry out joint marketing and other communication activities with our partners or other third parties such as your mobile operator. To avoid repetition or unnecessary communication and customize relevant information for you, we may need to match the information collected by AMBRION SolarPlant and the information collected by the partners with the premise of being allowed by law.

The above authorised third parties shall not use your personal data for any other purposes. We ask them to comply with this policy and take appropriate security measures to protect your personal data.

With the continuous development of our business, we and our affiliates may engage in mergers, acquisitions, transfer of assets or similar transactions and the information we collect may be diverted as part of such transactions.

We or our affiliates may also use or disclose your personal information for the following purposes:

i. To comply with applicable laws and regulations;

ii. To comply with the court order or other legal process;

iii. To comply with the requirements of the relevant government agencies;

iv. Usages that are reasonably necessary for the observance of applicable laws and regulations, the protection of the public good, or the protection of the safety and legal rights of our customers, us or our group companies, other users or employees.

5.6. Information Security

We retain your personal information only in the period necessary for the purposes described in this Privacy Policy and as required by applicable laws and regulations. We use a variety of security technologies and procedures to prevent the loss of information, improper use, unauthorised reading or disclosure. However, please understand that due to technical limitations and possible malicious network means, it is impossible to always guarantee the absolute security of information although we try our best to protect the security of information.

5.7. The application scope of Privacy Policy

This Privacy Policy applies to all services within the AMBRION SolarPlant Portal Software. However, for the privacy policies of certain services, we will be more specific about how your information is used in these services. If there is any inconsistency between the privacy policy of the particular service concerned and this Privacy Policy, the privacy policy of that particular service is applicable.

Please note that this Privacy Policy does not apply to the following situations:

The information collected by third party services and accessed through our services, including any third party websites;

The information collected by other company or institutions conducting promotion service through our service

5.8. Changes

We may properly amend clauses in this Privacy Policy, and we will inform you by showing the noticeable position implication on website, or sending you emails or other ways before taking effect of this policy. After being noticed, if you continue to use our service, you will agree to be bound by this amended Privacy Policy.

VI. The copyright statement

6.1 The copyright of text, pictures, audio, video and other contents on this portal shall be owned SolarBOS Pty Ltd. or jointly owned by Guangzhou Sanjing Electric Co., Ltd. and the authors, and shall not be arbitrarily reprinted without the permission from this portal.

6.2 The unique logo, design, layout and other copyright of this portal shall belong to SolarBOS Pty Ltd. and shall not be arbitrarily copied or reproduced without the permission from this portal.

6.3 To use any content of this portal, these contents should be marked with from “AMBRION SolarPlant” and the author’s name; in case royalties are required to pay according to the law, the portal and the author should be informed and paid remuneration, and all legal responsibility shall be taken by the users who use the contents.

6.4 The portal has the priority of all works for other purposes, including but not limited to website, E-zine, print publication and so on, but the author will be informed before the use and paid remuneration according to the industry standard.

6.5 The contents on this portal only represent the author’s own position and opinion, and have nothing to do with the portal. The author himself shall assume all legal responsibility.

6.6 The portal reserves the right to resort to law for maliciously reproduced the contents of the portal.

VII. Statement of responsibility

7.1 Users explicitly agree that the risks and all the consequences of their use of the portal network services will be entirely borne by the users themselves and AMBRION SolarPlant does not assume any responsibility.

7.2 The portal could not guarantee that the network service will certainly meet the users’ requirements, and will not guarantee the promptness, safety and accuracy of the network service.

7.3 The portal does not guarantee the accuracy and completeness of the external links set up for the convenience of the users. At the same time, the portal is not responsible for the contents on any web page to which these external links are not actually controlled by the portal.

7.4 The portal is not responsible for interruption or other defects in network services caused by force majeure or other reasons not controlled by the portal, but will try best to reduce the loss and impact on the users. Force majeure in this agreement means unforeseeable, unavoidable and insurmountable objective situations, including but not limited to war, typhoon, flood, fire, lightning or earthquake, strike, riot, legal illness, hacking, network virus, technical controls by telecommunications sector, government actions or any other natural or man-made disasters.

7.5 The portal is not responsible for any quality defects of the following products or services provided to the users and any losses caused by those quality defects:

(1) Various network services provided to users by this portal for free;

(2) Any product or service presented to users by this portal.

7.6 The portal reserves the right to modify or terminate the Service (or any part thereof) temporarily or permanently at any time, regardless of releasing notification or not, and the portal shall not be liable to the User and any third party.

VIII. Supplementary Provisions

8.1 This Agreement is governed by, and shall be construed in accordance with the laws of Australia, without giving effect to any principles of conflicts of law.

8.2 Any dispute or disagreement arising between users and AMBRION SolarPlant Portal shall be negotiated in a friendly way first; in case the dispute or disagreement can’t be solved through negotiation, any party shall submit the dispute or disagreement to People’s Court of Australia for prosecution.

8.3 This Agreement is written in English.

8.4 If any provision of this Agreement is for any reason totally or partially invalid or unenforceable, the remaining provisions of this Agreement shall remain valid and binding.

8.5 The power to interpret and amend this agreement shall be owned by SolarBOS Pty Ltd.

8.6 “The Portal” refers to the AMBRION SolarPlant Portal, including but not limited to AMBRION SolarPlant Portal/AMBRION SolarPlant O&M APP/AMBRION SolarPlant O&M Portal unless otherwise specified.
